Assumption Of Risk

Read Before Signing: 

ACKNOWLEDGEMENT OF RISK, ASSUMPTION OF RISK, RELEASE OF LIABILITY, AND HOLD HARMLESS AGREEMENT

I understand that participation in guided fishing trips, boating activities, shore fishing, wade fishing, outdoor recreation, educational events, and related activities provided by Gunnison Sports Outfitters, LLC d/b/a GSO Fishing (“GSO Fishing”) involves inherent risks that cannot be eliminated regardless of the care taken by GSO Fishing, its owners, guides, employees, contractors, or agents.

These risks include, but are not limited to:

• Boating accidents
• Slips, trips, and falls
• Drowning
• Changing weather conditions
• Lightning
• High winds
• Wildfire and smoke conditions
• Road and access hazards
• Wildlife encounters
• Hook, knife, and fishing equipment injuries
• Fish handling injuries
• Water-related illnesses
• Equipment failure
• Vehicle transportation
• Physical exertion
• Exposure to sun, heat, cold, wind, and other environmental conditions
• Any other risks associated with outdoor recreation activities

I understand that these risks may result in personal injury, illness, property damage, disability, or death.

I voluntarily choose to participate and knowingly and freely assume all risks associated with participation.

In consideration of being permitted to participate in activities offered by GSO Fishing, I hereby release, waive, discharge, and hold harmless Gunnison Sports Outfitters, LLC d/b/a GSO Fishing and its owners, guides, employees, contractors, agents, and representatives from any and all claims, demands, damages, causes of action, liabilities, costs, or expenses arising from or related to my participation, except to the extent prohibited by applicable law.

I agree to comply with all instructions provided by guides and staff during any activity.

I understand that marijuana and other federally prohibited controlled substances are prohibited during trips conducted on federal lands and waters. Participants are responsible for complying with all applicable federal, state, and local laws.

In the event of an emergency, I authorize GSO Fishing personnel to seek emergency medical treatment on my behalf if I am unable to communicate. I understand that I am responsible for any costs associated with such treatment.

If I am signing on behalf of a minor participant, I certify that I am the parent or legal guardian of that minor and agree to these terms on the minor’s behalf.

I have carefully read this document, fully understand its contents, and sign it voluntarily of my own free will.

I understand that this agreement applies to all trips and activities I participate in with GSO Fishing unless revoked in writing and acknowledged by GSO Fishing.

Read Before Signing:

MEDIA RELEASE AND AUTHORIZATION

I hereby grant permission to Gunnison Sports Outfitters, LLC d/b/a GSO Fishing (“GSO Fishing”) to photograph, record, film, or otherwise capture my likeness, image, voice, statements, and participation during any guided fishing trip, class, webinar, course, event, or other GSO Fishing activity.

I further grant permission for GSO Fishing to use any photographs, videos, audio recordings, testimonials, comments, reviews, or other media that I voluntarily submit to GSO Fishing.

I understand that these materials may be used by GSO Fishing for advertising, marketing, educational, fundraising, promotional, public relations, social media, website content, podcasts, videos, print materials, digital publications, email marketing, and other business purposes in any medium now known or later developed.

I grant GSO Fishing the unrestricted right to edit, reproduce, publish, distribute, display, transmit, and otherwise use such materials without limitation.

I understand and agree that:

• I will not receive compensation for the use of these materials.
• I waive any right to inspect or approve the finished product or its use.
• GSO Fishing is under no obligation to use any submitted or captured media.
• Any goodwill, value, or benefit resulting from the use of such materials belongs solely to GSO Fishing.

I understand that this authorization is voluntary and may be revoked at any time by providing written notice to:

Any revocation will apply only to future uses and will not affect materials already published, distributed, produced, or relied upon prior to receipt of the revocation.

If I am signing on behalf of a minor participant, I certify that I am the parent or legal guardian of that minor and authorize GSO Fishing to use the minor’s likeness, image, voice, and participation under the terms of this agreement.

I certify that I have read and understand this Media Release and Authorization and voluntarily agree to its terms.
